Principles
SEC. 1.
No person shall deprived life, liberty or property of other person without due process of law. Along with this, no person shall deny the equality of the law’s protection.
SEC. 2.
The responsibility of the people to secure themselves, their houses, papers and effects, from any unreasonable searches and abduction under any invalid nature and any purpose, shall be firm. Also, it is a responsibility to ask for search warrant or warrant of arrest, validated and determined personally by a higher authority, which states reasons for the searching of described place and for seizing that person or other things.
SEC. 3.
(1) It is the person’s responsibility to keep every communication and correspondence in private, in a wise way. That is, as long as the subject will not be a concern to public safety, the law and the country as a whole, the privatization of any communication is a valid action.
(2) Any evidence that will lead to any violation of this or the preceding section shall be prohibited, regardless of any arranged purpose.
SEC. 4.
The freedom of speech, of expression, or of the press, or people’s assembly and petition the Government for the rectification of grievances shall not be overuse and misuse by the people who owns them as a right, for the law cannot pass abridging this freedom.
SEC. 5.
It is the person’s responsibility to respect the establishment of religious groups of other people, as well as of what they exercise thereof. Moreover, the traditions and enjoyment of religious profession and worship, which don’t discriminate nor prefer, shall be exercise by the person who is a member of it. Since there is no religious test that is required for the exercise of civil or political rights, a person shall not be constrained with his political will.
SEC. 6.
The autonomy of residence and the changing of it is the person’s responsibility to keep it away from damages, unless an order of the court is issued. Traveling is also a part of this responsibility since the law hasn’t something to do with it, except for lawful purposes like national security, public safety and health.
SEC. 7.
People shall disseminate valid and accurate information on matters of public concern. They should exercise their right to access government records, files and data and used it as a basis for policy development. But still, not all government records, files and data can be publicized for the law has set a limitation with it.
SEC. 8.
The people shall not limit their responsibility to form unions, associations or societies that possess a common goal that doesn’t contrast the law, and that is for the good, not only of those who are in the group, but also the country and their fellowmen.
SEC. 9.
Private property should present impartial reimbursement or returns if and only if this property is taken for public use.
SEC. 10.
All laws, before it will be passed, should not prejudice nor harm any obligation of contracts.
SEC. 11.
Free access to the courts and quasi-judicial bodies, as well as adequate legal assistance, should be employed by any person who cannot afford it, in case they need it.
SEC. 12.
(1) If under investigation for the commission of an offense, the person would be accountable for any statement that he/she would say. It would also be his/her responsibility to find a preferred counsel, unless he/she could not afford one. In that case where counsel can not be acquired, it would be the government’s responsibility to provide the accused with one.
(2) If the person has been subjected to torture, force, violence, threat, intimidation, or any other means which vitiate the free will, he/she has to speak up and let the government know about this violation of his/her right. He/she must also take it unto him/herself to report any unnecessary detention.
(3) The person will have the responsibility to report being forced to make a confession or to stop such an act from happening.
(4) The government must see to it that the necessary penal and civil sanctions are provided for violations of this section in the Bill of Rights, as well as compensation to the rehabilitation of victims of torture or similar practices, and their families.
SEC. 13.
The right to bail must be granted to a person if he/she is not charged with offenses punishable by reclusion perpetua when evidence of guilt is strong. The government must be able to meet what is given in the right, and the persons charged must report if this right is not granted unto him/her.
SEC. 14.
(1) The government must not charge someone with a criminal offense without undergoing a process of law. The individual being charged must also report any violation regarding this right.
(2) It would be the responsibility of the accused to avoid doing other unlawful acts if he/she is not yet proven guilty of a charge. After arraignment, the accused must be present at every trial.
SEC. 15.
The government must properly know when to suspend the writ of habeas corpus when public safety is involved.
SEC. 16.
A person must bear in mind that he/she has the right to a speedy disposition of his/her case and must know how to report such a violation of a right.
SEC. 17.
A person must bear in mind that he/she must be careful of what he/she says in trial or otherwise. Also, he/she must be able to recognize when he/she is being led to witness against himself/herself and be able to do the proper action.
SEC. 18.
(1) A person must be able to report being detained solely by reason of his political beliefs and aspirations.
(2) The government must not force someone to do civil service unless he/she has been assigned to do so for doing an offense.
SEC. 19.
(1) The government should not collect excessive taxes, nor shall they impose death penalty without very valid reasons.
(2) Violations stated in this section of the Bill of Rights must be reported by the person involved. And it would be the responsibility of the government to do the proper actions against such violations.
SEC. 20.
If a person is imprisoned due to the fact stated in this section of the Bill of Rights, he must be able to report this to the government.
SEC. 21.
A person must be careful in not to make an offense twice even if he/she has the right stated in this section of the Bill of Rights.
SEC. 22.
The government must not enact any ex post facto law or bill of attainder.
